ONE YEAR PRODUCT WARRANTY

Cellular Subscriber Radio Telephone Equipment



SCOPE AND DURATION OF WARRANTY:

Motorola India Limited ("Motorola"), Warrants to the customer (the "Customer") each of its Cellular Subscriber Radio Telephone Products (the "Equipment") purchased hereunder against defects in material and workmanship under normal use and service for a period of one (1) Year commencing from the date of purchase. Motorola at its option, will at no charge either repair, or replace, any equipment during the warranty period, providing it is returned in accordance with the terms of this limited warranty to a servicer authorised by Motorola to perform warranty work on Cellular Subscriber Radio Telephone Products. Repair may, at Motorola's option, include the replacements of parts or boards with functionally equivalent reconditioned or new parts or boards. Replacements for parts, boards or Equipment will be warranted for the balance of the original warranty period or for ninety (90) days, whichever is longer. All replaced parts or boards and Equipment shall become the property of Motorola.

This express warranty is extended by Motorola to the original Customer only, and is not assignable or transferable. This is the complete warranty for the Equipment and Motorola assumes no obligation or liability for additions or modifications to this warranty unless made in writing and signed by a duly authorised representative of Motorola.

Motorola Cannot be responsible in any way for any ancillary equipment not furnished by Motorola which is attached to and used in connection with the Equipment or for operations of the Equipment with any ancillary equipment.



THE WARRANTY DOES NOT COVER:

(a) Defects or damage resulting from use of the Equipment in other than its normal customary manner, (b) Defects or damage resulting from misuse, accident or neglect; (c) Defects or damage from improper testing, operation, maintenance, installation, alteration, modification, or adjustment; (d) Breakage or damage to antennae unless caused directly by defects in material or workmanship; (e) Equipment disassembled or repaired in such a manner as to adversely affect performance or prevent adequate inspection and testing to verify any warranty claim; (f) Equipment which has had the serial number removed or made illegible; (g) Rechargeable batteries (Which are covered under a separate warranty); (h) Defects or damage due to spills of food or liquids; (i) All plastic surface and all other externally exposed parts that are scratched or damages due to Customer normal use; (j) Products rented;



HOW TO GET WARRANTY SERVICE:

In order to obtain warranty service, return the equipment to a Motorola authorised servicer. In case of a Vehicular: installation, the vehicle in which the Equipment is installed should be driven to the authorized servicer, as analysis of any problem may require inspection of the entire vehicular installation. In the case of non-vehicular installation, the unit together with any detachable parts such as antennae, battery packs, and charges, must be delivered to the authorised servicer, transportation and insurance prepaid paid. When sent or brought to any authorised servicer, the Equipment must be accompanied by your name address and telephone number, cellular telephone number, name of cellular carrier a discretion of the problem, and a receipt bearing the serial number, date of sale, and date of delivery or comparable proof of date of sale and date of delivery.



GENERAL PROVISIONS:

The warranty set forth Motorola's responsibilities regarding the Equipment. Repair or replacement at Motorola's' option is the Customers exclusive remedy. Replacements for parts, boards or Equipment will be warranted for the balance of the original warranty period or for ninety (90) days, whichever is longer. THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER EXPENSES WARRANTIES, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY QUALITY OR FITNESS, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. IN NO EVENT SHALL MOTOROLA BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE EQUIPMENT, OR FOR ANY LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, LOST PROFITS OR SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES. AS THE CELLULAR CARRIERED BY MOTOROLA, NO WARRANTY is MADE AS TO, AND MOTOROLA ASSUMES NO RESPONSIBILITY AND LIABILITY FOR, THE CARRIERS RANGE, COVERAGE, DESIGN, GRADE OF SERVICE, AUDIO QUALITY, EQUIPMENT COMPATIBILITY, SYSTEM DOWN-TIME, OR BILLING PRACTICES.



RECHARGEABLE BATTERIES

Nickel-Cadmium batteries and Nickel Metal Hydride batteries and Lithium Ion batteries sold by Motorola are warranted to be free from defects in workmanship and material for a period of six (12) months from the date of shipment. This express warranty is extended by Motorola to the original Customer only.

THIS WARRANTY IS GIVEN, IN LIEU OF ALL OTHER EXPRESS WARRANTIES, IMPLIED WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, QUALITY, OR FITNESS, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. IN NO EVENT SHALL MOTOROLA BE LIABLE FOR ANY DAMAGES EITHER INCIDENTAL OR CONSEQUENTIAL TO THE FULL EXTENT SUCH MAY BE CLAIMED BY LAW.

The Customer shall be responsible for all charges incurred in returning batteries to Motorola. Motorola will be responsible for all charges incurred in shipping replacement batteries to the Customer. Replacement batteries are warranted only for the remaining unexpired warranty period of the original battery. This warranty becomes void if: (a) the batteries are charged other than Motorola approved battery chargers specified for the charging of the battery, (b) Any of the seals on the battery enclosure or cells are broken or show evidence of tampering; (c) The battery is used in Equipment or service other than the Radio Equipment for which it is specified.



LIMITATIONS OF WARRANTY COVERAGE

The following examples are not covered under Cellular Warranty

  • Transfer of ownership has taken place.
  • Defects or damage resulting from use of the product in other than its intended use.
  • Defects or damage from misuse, accidents or neglect.
  • Defects or damage from improper testing, operation, maintenance, installation, adjustment or any alteration or modification.
  • Breakage or damage to antennae, unless caused directly by defects in material or workmanship.
  • Products disassembled or repaired in such a manner that performance is affected.
  • Products that have had the Serial Number removed, altered or age illegible and no proof of purchase is provided.
  • Defects or damage due to spills of liquid or other substances.
  • Curly cords that have been stretched or crimped.
  • All external parts that are scratched or damaged due to Customer normal use.
  • Rented products.
  • Operation or damage caused by ancillary equipment used with the product.
  • Non-service personnel opening the product without permission of Motorola Cellular.
